Process for Port of Entry (POE) Examinations of Temporary Residents

Process at POEs

Border services officers must be satisfied that all admissibility requirements have been met before authorizing entry of a foreign national to Canada.

Step 1 – Primary inspection line

The foreign national arrives at a POE and is examined at a primary inspection kiosk or by a border services officer at the primary inspection line.

The foreign national is admitted to Canada if the border services officer or primary inspection kiosk is satisfied that the foreign national meets the admissibility requirements. Otherwise the foreign national is referred for a secondary examination.

Step 2 – Secondary examination

At immigration secondary, a border services officer examines the foreign national, including reviewing documentation and Canada Border Services Agency (CBSA) systems, to determine admissibility.

If the person is admissible, then the officer may do the following (this list is not exhaustive):

  • stamp the subject’s passport if applicable or requested
  • issue the appropriate temporary resident document

The border services officer may also require that a deposit be posted to ensure the person complies with the terms and conditions imposed.

If the person is alleged to be inadmissible, then the border services officer

  • may write a report, per subsection 44(1) of the Immigration and Refugee Protection Act (IRPA), outlining the allegations of inadmissibility and forward it to a Minister’s delegate for review
  • may issue a temporary resident permit (TRP) to overcome the admissibility temporarily and admit entry to Canada
  • shall allow the person to withdraw their application and leave Canada if the person chooses to do so; see subsection 42(2) of the Immigration and Refugee Protection Regulations (IRPR) for the exception

Step 3 – Minister’s delegate review

A Minister’s delegate reviews the report of alleged inadmissibility.

If the report is found valid, then the Minister’s delegate upholds the report and decides on the disposition of the case.

The disposition depends on the allegations and circumstances of each case and may include:

  • referring the case to an admissibility hearing
  • allowing the person to leave Canada
  • issuing a TRP
  • issuing a removal order

The Minister’s delegate may decide if a detention is warranted.

If the report is found not valid, then the Minister’s delegate may take no action on the report and authorize the person to enter Canada, or they may prepare another report with the accurate allegation.

Length of stay

A border services officer at the POE determines the length of time a temporary resident may remain in Canada, per subsection 183(2) of the Immigration and Refugee Protection Regulations (IRPR).

Note: In general, stamps issued by a border services officer at a POE are valid for a period of 6 months from the date of entry. If a client does not receive a stamp in their passport due to being processed through a primary inspection kiosk, the client receives a validity period of 6 months from the date of entry.

If a handwritten date has been placed under the stamp, the period of authorized stay expires on that date. As border services officers are not required to place a stamp in a client’s passport at the primary inspection line or primary inspection kiosk, when a client leaves and seeks re-entry to Canada, the border services officer may elect not to stamp the passport. The subject then receives a 6-month visitor status at the time of the new entry.

If parents and grandparents who possess the temporary resident super visa or letter of introduction have a stamp in their passport with no handwritten date, or if they have no stamp, then the period of authorized stay is 2 years from the date of entry.

General conditions

Border services officers at a POE may impose prescribed conditions on a temporary resident at the time of entry.

Conditions are imposed to ensure that the foreign national adheres to the period and purpose for which they sought entry. Conditions also make foreign nationals aware of the need for formal authorization before extending that period or varying the purpose of their stay.

  • Section R183 outlines the following conditions imposed on every temporary resident:
    • They may not engage in work without authorization.
    • They may not engage in studies without authorization.
    • They must leave Canada by the end of the period authorized for their stay.
  • Section R184 lists specific conditions imposed on members of a crew.
  • Section R185 states that an officer may impose, vary or cancel conditions.

Once admitted, temporary residents may apply to do any of the following:

  • change their conditions
  • change their status
  • extend their status within Canada

Bulgaria Fast Track Citizenship and Permanent Residence Program

Bulgaria Fast-Track Citizenship Program . – PR and citizenship in 1 step: 

  • Financing Option of EUR 260,000, or Real Estate Purchase Option of EUR 430,000.
  • Supplemental Offering (EUR 80,000) allows a spouse or non-dependent child to apply for citizenship at the same time as the rest of the family.
  • Prices are locked-in at the time of investment (so not effected by market fluctuations)
  • Simpler and more stream-lined application process than the 2-step program
  • Cheaper than the 2-step program.

Bulgaria Permanent Residence Program . – 2-step citizenship; citizenship application after 1 year of PR: 

  • Applicant chooses either the Financing Option (EUR 155,000) or Real Estate Option (EUR 215,000) for the PR process.
  • After 1 year of PR, applicant chooses either the Financing Option (EUR 125,000) or Real Estate Option (EUR 215,000) for the Fast-Track citizenship process, so can ‘mix & match’ investment options.
  • Costlier in total, but smaller cash outlay initially
  • Citizenship pricing subject to change in future, based on market conditions
  • Bulgaria Permanent Residence Program (PR; citizenship application after 5 years of PR):
  • Applicant chooses either the Financing Option (EUR 155,000) or Real Estate Option (EUR 215,000) for the PR process.
  • Applicant waits 5 years and applies for standard citizenship (no additional investment required).

Benefits of the programs include:

  • Bulgaria PR will allow the applicant and his/her family to work, live and study in Bulgaria
  • Once Bulgaria becomes a member of Schengen (expected to occur in 2019), PR-holders will have visa-free access to all Schengen countries
  • Bulgaria citizens have the right to reside, work, and study anywhere in Europe
  • Bulgaria citizens have visa-free access to approx. 142 countries (including Canada and Europe)
  • Applicant receives PR in 4-6 months, and citizenship in less than 2 years in total (Fast-Track program)
  • Citizenship is transferrable by descent (to all children and grandchildren)
  • Applicants may choose either a Financing Option or Real Estate Purchase Option
  • No language requirement, no age limit, and no management experience requirement.

Quebec Investor Program

The Quebec Immigrant Investor Program has reopened on September 10th, 2018 until August 31st 2019. The Government Authority will only accept a maximum of 1900 cases.

In order to file your case, you need to be allotted a Unit from a Registered Financial Intermediary (also named “Broker”). Again, for this round, we are anticipating this Program to be oversold, which means that there will be more interested applicants than Units available.

The Quebec Immigrant Investor Program allows yourself, your spouse and your children of less than 22 years old (i.e. 21 years and under) to obtain a Canadian permanent resident visa. 

REQUIREMENTS

In order to qualify to the Quebec Immigrant Investor Program, we need to prove to the Canadian Government that you, alone or with accompanying spouse (including de facto spouse) that:

  • You have a net asset (bank account, real estates, company shareholding) of at least $2 000 000 CA obtained legally. Please note that you do not have to spend this amount, we just need to prove to the government that you own this amount.
  • You have at least for 2 years of management experience in the last 5 years. Management experience includes: in a legal farming, commercial or industrial business, or in a legal professional business where the staff, excluding yourself, occupies at least the equivalent of two full-time jobs, or for an international agency or a government or one of its departments or agencies.

INVESTMENT

The total amount of your investment is $380 496CA which is detailed as follows:

  • Processing fees: $15 496 CA (Bank draft drawn on a Canadian Bank to the benefit of Minister of Finance of Quebec);
  • Deposit of $30 000 CA to the Quebec Broker to be assigned (100% refundable if the application is rejected);
  • Remittance of $320 000 CA upon approval by the Quebec Government.

BC PNP Entrepreneur Immigration – Regional Pilot

The pilot aims to assist smaller communities around BC.

Known as the Entrepreneur BC Provincial Immigration Program (BC PNP), it is set to Launch early in 2019 and it is a two-year pilot program.

BC PNP to work in partnership with regional communities of less than 75,000 people to welcome approved immigrant entrepreneurs who want to open a new business.

Communities must be located farther than 30 kilometers from a population center of more than 75,000 people in order to be enrolled in the pilot.

The program is to help the smaller communities and in exchange they will nominate the business Immigrants.

Potential interested applicants must make a exploratory visit and get a referral from the visited community.

Among other eligibility criteria, candidates must:

  • have a minimum of $100,000 in eligible business investments;
  • have a minimum personal net worth of $300,000;
  • conduct an exploratory community visit;
  • have 3+ years of experience as an active business owner-manager or 4+ years as a senior manager within the last 5 years;
  • take on a minimum of 51 per cent ownership;
  • create a minimum of one new job for a Canadian citizen or permanent resident of Canada.

During the visit the Candidates will present their proposal to the designated pilot representative and obtain a referral.

All candidates will receive a score upon registering and the highest-scoring candidates will be invited to submit a full application to the BC PNP through monthly invitation rounds.

The pilot will open to registrations in early 2019 and will run for an initial period of two years.

Permanent Residence under the Self-Employed Persons Class

Self-employed persons (excluding those destined for Quebec)

Self-employed immigrants must have relevant experience within the five-year period immediately preceding the date of application.

Relevant experience in respect of a self-employed person, means:

  • For at least two years in the period beginning five years before the date of application:
  • Self-employment in cultural activities or athletics
  • Participation, at the world-class level, in cultural activities or athletics.

Features

  • No immigration conditions are imposed on this class.
  • Self-employed immigrants must have the experience, intention and ability to:
  • establish a business that will, at a minimum, create an employment opportunity for themselves and that will make a significant contribution to cultural activities or athletics in Canada.
